Aiweihui may appoint supervisors in units where smoking is prohibited in public places. Article 4 Smoking is prohibited in the following public places within the administrative area of this Municipality:
Nurseries, kindergartens and youth activity bases;
(2) Waiting area, diagnosis and treatment area and ward area of medical institutions;
(three) classrooms, laboratories, reading rooms and places where teachers and students concentrate their activities in various schools;
(4) conference room;
(5) theaters, song and dance entertainment halls, video projection halls and entertainment halls (rooms);
(six) indoor sports training, competitions and business premises;
(seven) the reading room of the library, the reference room of the archives, and the exhibition halls of museums, art galleries, exhibition halls and science and technology museums;
(eight) the business premises of posts and telecommunications, financial institutions, large and medium-sized shops (fields) and bookstores;
(nine) city bus, civil aviation, railway, long-distance passenger ticket office, waiting room;
(ten) other public places where smoking is prohibited as determined by the Municipal People's Government.
In the public places listed in Items (5), (6), (7) and (8) of this article and the waiting room specified in Item (9), smoking rooms (areas) with obvious signs can be set up and reported to Ivy's office for the record. Article 5 The whole society should support the work of banning smoking in public places.
All government departments, organs, enterprises, institutions and social organizations should carry out publicity and education on the health hazards of smoking and the prohibition of smoking in public places. Article 6 Units that prohibit smoking in public places shall perform the following duties:
(a) to formulate and implement the smoking ban management system of the unit;
(two) do a good job in the publicity and education of smoking in public places;
(three) set up a unified and eye-catching "no smoking" sign in the place where smoking is prohibited in this unit;
(4) Smoking equipment, signs or articles with tobacco advertisements shall not be placed in places where smoking is prohibited in the unit;
(5) Smokers in places where smoking is prohibited in this unit should be advised to stop smoking. Article 7 Citizens have the right to ask smokers in public places where smoking is prohibited to stop smoking.
Citizens have the right to require units that prohibit smoking in public places to perform the duties specified in Items (3), (4) and (5) of Article 6 of these Provisions.
Citizens have the right to report violations of these provisions to the city or district (city) county Ivy Association. Eighth in violation of the provisions of article sixth (three) or (four) of these measures, the city or district (city) county Ivy will order the unit to make corrections within a time limit; If no correction is made within the time limit, a fine ranging from 1000 yuan to 5,000 yuan shall be imposed. Ninth in violation of the provisions of article sixth (five), do not discourage smokers in no smoking places, by the city or district (city) county Ivy to impose a fine from 50 yuan to 500 yuan.
If smokers in no-smoking places do not listen to dissuasion, the supervisor appointed by Ivy Club will impose a fine of more than 5 yuan 10 yuan. Supervisors should show their law enforcement certificates when enforcing the law. Tenth city and district (city) county Ivy Association shall commend and reward the units and staff who have made remarkable achievements in the work of banning smoking in public places. Article 11 Whoever refuses or obstructs law enforcement officers from performing official duties according to law shall be punished by public security organs in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Twelfth when making administrative punishment, it shall issue a written decision on administrative punishment. Fines shall be turned over to the finance at the same level in accordance with relevant laws and regulations. Thirteenth if a party refuses to accept the decision on administrative punishment, it has the right to apply for administrative reconsideration or bring an administrative lawsuit according to law. If a party fails to apply for reconsideration or bring a lawsuit within the time limit, nor complies with the decision on punishment, the organ that made the decision on administrative punishment shall apply to the people's court for compulsory execution according to law. Fourteenth law enforcement officers should conscientiously perform their duties, enforce the law impartially and civilly. Those who fail to perform their duties or neglect their duties shall be criticized and educated or given administrative sanctions by their units or higher authorities. If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Fifteenth organs, organizations, enterprises and institutions may, according to the actual situation, determine the places where smoking is prohibited in units other than Article 4 of these Provisions, and do their own management work with reference to these Provisions. Sixteenth the problems in the specific application of these Provisions shall be interpreted by the Chengdu Municipal People's Government.
