(1) Non-operating buildings and halls include: office buildings, conference buildings, auditoriums, guest houses, exhibition halls, memorial halls, clubs, homes for retired cadres, sanatoriums, cadres' dormitories and wards with high decoration, and such projects under the name of various centers;
(2) Business buildings and halls include tourist hotels (including hotels and restaurants, the same below), foreign-related apartments, office buildings, playgrounds and other business buildings and halls. Article 3 Foreign-related hotels, apartments and office buildings that belong to business should be built in a planned way according to the needs of tourism development. In addition to specially approved projects, some low-and medium-standard projects are mainly built. Article 4 The following buildings, which are built according to the local general civil building standards, shall be handled according to the basic construction procedures, and those which are higher than the local general civil building standards or have a total investment of more than 30 million yuan (including 30 million yuan, the same below) shall be managed according to the provisions of these regulations:
(1) Teaching buildings, archives, scientific research buildings, data buildings, experimental buildings, theaters, museums, science and technology museums, libraries, rehearsal halls, cultural stations and gymnasiums built by cultural, educational, health and sports units according to their career development and business needs;
(two) the business premises of the scientific research and design unit;
(3) Labor protection houses and cultural welfare facilities built by industrial and mining enterprises;
(four) hotels, restaurants, shopping malls and comprehensive commercial service buildings in the commercial service industry;
(5) Savings outlets in the banking system;
(6) Simple guest houses, canteens and auditoriums for administrative organs and mass organizations. Article 5 These Regulations shall apply to state organs, organizations, enterprises and institutions owned by the whole people. Article 6 The construction of buildings and halls must strictly go through the examination and approval procedures, and the approved buildings and halls must be incorporated into the departmental and local capital construction plans. Without approval, no unit may build or engage in unplanned projects. Chapter ii examination and approval of projects of buildings and halls article 7 projects of buildings and halls must be submitted for approval. Eighth project proposals with a total investment of more than thirty million yuan shall be examined and approved according to the following procedures:
(1) Local projects shall be reviewed by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning and reported to the State Planning Commission for approval;
(2) The projects built by the central unit in Beijing area shall be reviewed by the Capital Planning and Construction Committee and reported to the State Planning Commission for approval;
(3) The projects built by the central unit outside Beijing shall be examined by the competent department and submitted to the State Planning Commission for examination and approval after being approved by the Planning Commission of the province, autonomous region, municipality directly under the Central Government and cities under separate state planning where the projects are located;
(four) projects with a total investment of more than 200 million yuan (including 200 million yuan, the same below) and some projects with a total investment of less than 200 million yuan shall be reported to the State Council for approval by the State Planning Commission. Ninth project proposals with a total investment of less than 30 million yuan shall be examined and approved according to the following procedures;
(1) Construction projects of leading organs of central ministries, provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning (including joint construction projects with other units and projects carried out in the name of subordinate units) shall be reported to the State Planning Commission for examination and approval, among which the State Planning Commission shall put forward examination opinions and report them to the State Council for examination and approval;
(2) Construction projects other than those mentioned in the preceding paragraph shall be examined and approved by the competent authorities or the people's governments of provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning according to their affiliation. Article 10 The project proposal of a building, a museum or a museum with a centralized industry department must be approved by the centralized industry department before it is submitted for examination and approval; Chinese-foreign joint ventures and Chinese-foreign cooperative buildings and halls must be approved by the foreign economic relations and trade departments before being submitted for examination and approval. Article 11 The principle of "audit first, then construction" shall be applied to the projects of buildings, halls and museums. After the project commencement report is audited by the audit department, it must be submitted for approval according to the following procedures:
(a) approved by the the State Council or the State Planning Commission and audited by the National Audit Office;
(two) with the approval of the competent department or the people's governments of provinces, autonomous regions, municipalities directly under the central government and cities under separate state planning, the audit institutions of the competent department or the people's government shall conduct the audit. Twelfth buildings and halls of the project start-up report in accordance with the following procedures for examination and approval:
(a) projects with a total investment of more than 30 million yuan shall be reviewed, balanced and summarized by the State Planning Commission in July and August each year and reported to the State Council for approval;
(2) Projects with a total investment of less than 30 million yuan shall be examined and approved by the competent department or the people's governments of provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning in July and August each year, and reported to the State Planning Commission for the record. The State Planning Commission shall, within two months after receiving the filing documents, put forward opinions on projects that do not agree with the construction;
(3) Projects in Beijing area shall be submitted to the State Council for approval by the Capital Planning and Construction Committee. Thirteenth projects in military buildings and halls shall be examined and approved in accordance with the following procedures:
(a) the project proposal for construction in Beijing area shall be submitted to the Central Military Commission for approval by the competent military department after obtaining the consent of the Capital Planning and Construction Committee. The commencement report shall be submitted to the State Council for approval by the Capital Planning and Construction Committee;
(2) For projects outside Beijing with a total investment of more than 30 million yuan, the project proposal and commencement report shall be submitted to the Central Military Commission for approval; If the total construction investment is less than 30 million yuan, the project proposal and commencement report shall be examined and approved by the competent military department.
