Chapter I General Provisions

Article 1 In order to protect the pensions and preferential treatments for servicemen and safeguard the legitimate rights and interests of the objects of pensions and preferential treatments, these measures are formulated in accordance with the Regulations on Pensions and Preferential Treatment for Servicemen and the Regulations on the Commendation of Martyrs, combined with the actual situation of this province.

Article 2 Servicemen of China People's Liberation Army (hereinafter referred to as soldiers), disabled soldiers, demobilized soldiers, survivors of martyrs, survivors of soldiers who died in the line of duty, and survivors of deceased soldiers are collectively referred to as the objects of pension and preferential treatment, and enjoy pension and preferential treatment in accordance with the provisions of the state and this province.

Article 3 The people's governments at or above the county level shall strengthen the work of pensions and preferential treatment for servicemen, coordinate and solve the problems arising in the work of pensions and preferential treatment for servicemen in a timely manner, ensure that pensions and preferential treatment for servicemen are compatible with the national economic and social development, and ensure that the life of the recipients of pensions and preferential treatment is not lower than the local average living standard.

Article 4 The funds needed for military pensions and preferential treatment shall be borne by the people's governments at all levels of provinces, cities and counties (cities, districts) in addition to the arrangements made by the central government, and the people's governments of provinces, cities and districts shall give subsidies to those counties (cities, districts) with particularly difficult finances.

The funds for pensions and preferential treatment for servicemen shall be used exclusively, and shall be subject to the supervision of the financial and auditing departments.

Article 5 The civil affairs departments of the people's governments at or above the county level shall be responsible for the work of pensions and preferential treatment for servicemen within their respective administrative areas.

State organs, social organizations, enterprises and institutions within the administrative region of this province shall, in accordance with the provisions of the state and this province, perform their respective responsibilities and obligations for pensions and preferential treatment for servicemen.

Encourage social organizations and individuals to contribute to the cause of pensions and preferential treatment for servicemen.

Article 6 The civil affairs departments of the people's governments at or above the county level may entrust pension and preferential treatment services suitable for social forces by purchasing services.

Article 7 People's governments at or above the county level and relevant departments shall, in accordance with the relevant provisions of the state and the province, commend or reward units and individuals that have made remarkable achievements in the work of pensions and preferential treatment for servicemen.

Chapter II Death Pension

Article 8 If a soldier dies and is assessed as a martyr, or is confirmed to have died in the line of duty, his survivors shall enjoy pensions in accordance with the provisions of the State and these Measures.

Article 9 For the survivors of martyrs, soldiers who died in the line of duty and soldiers who died, the civil affairs departments of the people's governments of counties (cities, districts) shall respectively issue the Certificate of Martyrs in People's Republic of China (PRC), the Certificate of Soldiers who died in the line of duty in People's Republic of China (PRC) and the Certificate of Death of Soldiers in People's Republic of China (PRC) (hereinafter referred to as certificates).

The holder of the certificate shall be determined by the survivors of the soldiers through consultation, and shall inform the civil affairs department of the county (city, district) people's government in writing; If negotiation fails, the civil affairs department of the county (city, district) people's government shall issue them in the following order:

(1) Parents (dependents);

(2) spouse;

(three) children, if there are multiple children, to the eldest son;

(four) brothers and sisters, there are more than one brother and sister, to the elderly.

It doesn't belong to anything, and no certificate will be issued.

Article 10 Survivors of martyrs enjoy the praise of martyrs and one-time pension, while survivors of soldiers who died in the line of duty and survivors of deceased soldiers enjoy one-time pension. Martyrs' commendation gold and one-time pension shall be paid in turn by the civil affairs department of the people's government of the county (city, district) where the holder's household registration is located in accordance with the standards prescribed by the state:

(a) parents (dependents), spouses and children agree to allocate the amount, according to the amount determined through consultation, if consultation fails, the amount shall be paid in equal amount according to the number of people;

(2) If there are no parents (dependents), spouses or children, they will be given to brothers and sisters under 18 years of age and brothers and sisters who have reached 18 years of age but have no source of living expenses and were supported by soldiers before their death. If there are more than two brothers and sisters, the amount shall be paid according to the amount determined through consultation. If negotiation fails, equal payment shall be made according to the number of people.

Article 11 Survivors who meet the conditions for enjoying regular pensions shall be granted regular pensions by the civil affairs department of the people's government of the county (city, district) where their household registration is located.

The regular pension will be paid from the month when the civil affairs department of the county (city, district) people's government examines and confirms that the survivors meet the conditions for enjoying the regular pension.

Article 12 If a survivor who enjoys a regular pension dies, he shall be given the original regular pension for six months as a funeral subsidy, and his regular pension certificate shall be cancelled at the same time. The original regular pension will be stopped from the month of his death.

Chapter III Disability Pension

Thirteenth disabled soldiers retired or handed over to the government for resettlement, it shall apply to the civil affairs department of the people's government of the county (city, district) where the household registration is located within 60 days from the date of handling the formalities for retirement or handover.

Retired or transferred to the government for resettlement of disabled soldiers, disabled due to war and duty, medical institutions designated by the civil affairs department of the provincial people's government for review and appraisal; Disabled due to illness, the civil affairs department of the county (city, district) people's government and the military disability level examination and approval authority to verify and issue a written opinion, you can no longer review and identify the disability.

Article 14 Soldiers who are disabled due to war or on duty and fail to assess the disability level in time after retiring from active service may apply to the civil affairs department of the people's government of the county (city, district) where their household registration is located for re-assessment of the disability level according to the records in the archives or the original medical certificate.

The disability situation in disabled soldiers, who retired from active service, has seriously deteriorated. The original assessment of the disability level is obviously inconsistent with the disability situation, you can apply to the civil affairs department of the people's government of the county (city, district) where the household registration is located to adjust the disability level.

Fifteenth disabled soldiers retired from active service or handed over to the government for resettlement, and after going through the formalities for the transfer of pension relationship within the specified time, the disability pension will be paid from the year after retirement or handed over to the government for resettlement.

Disabled soldiers, who applies for the completion of disability rating and adjustment of disability rating, will receive the disability pension corresponding to the new rating or adjustment of disability rating from the next month after the approval of the civil affairs department of the introspective people's government.

Sixteenth disabled soldiers retired from active service, need long-term medical care or single inconvenience scattered, with the approval of the civil affairs department of the provincial people's government, can be centralized support; Decentralized placement, in accordance with the standards prescribed by the state to the nursing fee.

Article 17 If disabled soldiers, who is discharged from active service, needs to prepare rehabilitation AIDS, he may apply to the civil affairs department of the county (city, district) people's government where his household registration is located, and the civil affairs department of the municipal people's government with districts shall handle it in accordance with relevant regulations.

Article 18 If disabled soldiers, who retired from active service and was disabled due to war or duty, was identified by a medical and health institution designated by the civil affairs department of the municipal people's government with districts, and died of an old injury, the civil affairs department of the people's government of the county (city, district) where the household registration is located shall issue a one-time pension to his survivors in accordance with the standard of military pension for sacrifice in the line of duty. If the survivors meet the requirements, they will enjoy the pension benefits for the survivors of soldiers who died in the line of duty.

Article 19 disabled soldiers, who retired from active service due to war, duty or illness, will be given a disability pension of 12 months as a funeral subsidy, and his People's Republic of China (PRC) disabled soldiers Certificate will be cancelled at the same time. The original disability pension will be stopped from the month of his death.

Disabled soldiers, who was disabled due to war and duty, died of illness, and the survivors of the deceased soldiers enjoy pension benefits.

Chapter IV Preferential Treatment

Twentieth disabled soldiers holds the "People's Republic of China (PRC) disabled soldiers Card" and "People's Republic of China (PRC) Disabled Card", giving priority to the relevant treatment of disabled people of the same category and level.

Twenty-first conscripts in active service, their families approved by the county (city, district) people's government, in accordance with the standards prescribed by the state and province to give preferential payments. Family allowances for conscripts are shared by provinces, autonomous regions, cities and counties (cities, districts), and provincial finance gives financial subsidies to counties (cities, districts) with financial difficulties.

Article 22 Demobilized soldiers, veterans who return home sick, retired soldiers who participated in the war, rural retired soldiers over 60 years old and some children of martyrs shall be given regular quantitative subsidies by the civil affairs departments of the people's governments of counties (cities, districts) where their household registration is located in accordance with the conditions stipulated by the state and the province, so as to gradually improve their living conditions.

Article 23 Where demobilized soldiers who enjoy regular quantitative subsidies, veterans who return home sick, retired soldiers who participated in the war, rural retired soldiers over 60 years old and some martyrs' children die, the civil affairs department of the county (city, district) people's government shall issue funeral subsidies with reference to the local basic funeral service fee standards, and the original regular quantitative subsidies shall be stopped from the month of their death.

Article 24 disabled soldiers, survivors of martyrs, survivors of soldiers who died in the line of duty, survivors of deceased soldiers, demobilized soldiers, veterans who returned home sick, and war veterans who retired from active service shall enjoy corresponding medical security in accordance with the relevant provisions of the state and the province.

The medical security of retired personnel participating in the war shall be implemented in accordance with the relevant provisions of retired personnel participating in the war.

Article 25 disabled soldiers, survivors of martyrs, survivors of soldiers who died in the line of duty, survivors of deceased soldiers, demobilized soldiers, veterans who returned home sick, veterans who participated in the war, rural veterans over 60 years old and children of martyrs who partially retired from active service shall enjoy corresponding preferential housing treatment in accordance with the relevant provisions of the state and the province.

Twenty-sixth pensions and preferential treatments to apply for the minimum living guarantee, the following items are not included in the family income accounting:

(a) pensions, grants, honorary meritorious service fees and nursing fees enjoyed by the recipients of pensions and preferential treatment in accordance with the provisions;

(two) the preferential payments and bonuses enjoyed by the families of conscripts in accordance with the regulations, and the one-time economic subsidies for retired soldiers who are self-employed.

Article 27 People's governments at or above the county level and their relevant departments, various public schools and kindergartens shall, in accordance with the relevant provisions of the state and the province, give preferential treatment to the recipients of pensions and preferential treatment and their children to receive education.

Twenty-eighth discharged conscripts and junior noncommissioned officers who apply for national civil servants, institutions of higher learning, technical colleges and secondary vocational schools are given priority admission under the same conditions as other candidates.

Children of martyrs who meet the civil service examination conditions are given priority under the same conditions.

Twenty-ninth survivors of martyrs meet the employment conditions, the local people's government in Ministry of Human Resources and Social Security will give priority to providing employment services. If the survivors of martyrs have been employed, the employer shall give priority to retaining them when making economic layoffs.

Thirtieth government development of social welfare posts, should give priority to the placement of qualified pension positions; Social organizations, enterprises and institutions shall, under the same conditions, give priority to the recruitment and employment of pension and preferential treatment objects.

Article 31 Where the object of pensions and preferential treatment is engaged in production and operation, the administrative department for industry and commerce and the tax department shall give priority to the relevant formalities and reduce or exempt taxes and fees in accordance with the relevant provisions of the state.

Thirty-second servicemen with valid certificates, disabled soldiers with "People's Republic of China (PRC) disabled soldiers card" to enjoy the following preferential treatment:

(a) give priority to the purchase of tickets for trains, ships, long-distance buses and passenger planes, and disabled soldiers enjoys the preferential treatment of reducing the normal fare by 50%;

(2) Tickets for parks and scenic spots established or supported by the government are free;

(three) free access to public cultural centers, libraries, museums, science and technology museums, art galleries, exhibition halls, memorial halls and other places;

(four) enjoy priority services in the service windows of airports, stations, ports, hospitals and other units.

Soldiers enjoy preferential treatment by taking local buses, trams and rail vehicles with valid certificates, and the specific measures shall be formulated by the people's governments of cities and counties (cities, districts) with districts. Disabled soldiers can take buses, trams and rail transit in the city for free with the People's Republic of China (PRC) disabled soldiers Certificate.

Article 33 The special care hospitals and glorious homes established by the government (including the glorious rooms of nursing homes) provide services such as treatment, centralized support, medical visits and rotation recuperation for the elderly who meet the conditions stipulated by the state, and the required funds are included in the financial budgets of governments at all levels.

Thirty-fourth social welfare institutions such as nursing homes and welfare homes should give priority to receiving pensions and preferential treatments.

Encourage social forces to set up education, science and technology, culture, sports, transportation, tourism and other institutions to provide preferential services for the pensioners.

Article 35 The civil affairs departments of the people's governments at or above the county level, the people's governments at townships and sub-district offices shall regularly take the form of visits, condolences, discussions, etc. to provide spiritual comfort to the recipients of pensions and preferential treatment.

Chapter V Accountability

Thirty-sixth acts in violation of these measures, the relevant laws, regulations and rules have stipulated the legal responsibility, from its provisions; There are no provisions, in accordance with these measures.

Thirty-seventh civil affairs departments of the people's governments at or above the county level or other relevant departments have one of the following acts, and the relevant departments of the people's governments at the corresponding levels or the people's governments at higher levels shall order them to make corrections within a time limit; If no correction is made within the time limit, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Failing to pay pensions, subsidies and preferential payments within the prescribed time limit or procedures;

(2) Failing to go through the formalities for transferring the pension relationship within the prescribed time limit or according to the prescribed procedures;

(3) Failing to assess the level of disability within the prescribed time limit or according to the prescribed procedures;

(four) other acts of abuse of power, dereliction of duty, favoritism.

Thirty-eighth pensions and preferential treatment object has one of the following acts, the civil affairs department of the county (city, district) people's government shall give a warning and refund the illegal income within a time limit; If the circumstances are serious, the pensions and preferential treatment enjoyed by them shall be stopped; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) impersonator martyrs praise gold, pensions, subsidies, preferential payments;

(two) lying about the illness to defraud medical expenses;

(three) issued false certificates or forged documents, seals, to defraud the martyrs of praise, pensions, subsidies, preferential payments.

Chapter VI Supplementary Provisions

Article 39 These Measures shall be implemented as of July 1 year 1 day.
