Article 2 Anyone who engages in publishing books (including calendars, calendars, calendar paintings, New Year pictures, pictures, desk calendars, etc.). , the same below) must abide by these provisions in this province. Article 3 Book publishing must follow the basic principles set by the Constitution, adhere to the policy of serving the people and socialism, constantly improve the quality of book publishing, adhere to the principle of putting social benefits first, and strive to achieve the unity of social and economic benefits. Article 4 People's governments at all levels shall strengthen their leadership over book publishing and encourage the publication of excellent books.

Relevant government departments should formulate corresponding measures to actively support the publication of books with important ideological, academic, scientific and artistic values. Fifth provincial publishing administrative department is the administrative department in charge of book publishing, and shall perform the following duties:

(a) to implement the laws, regulations, rules and policies related to the management of book publishing, and to formulate management measures;

(2) Examining and approving the establishment of book publishing units;

(3) Examining and approving the book publishing topic selection plan;

(four) to guide the work of book publishing units and subordinate publishing administrative departments;

(five) to supervise and manage the quality of book publishing, review and identify books in Henan, and investigate and deal with illegal acts. Article 6 The establishment of a book publishing unit shall be examined by the provincial publishing administrative department, approved by the national publishing administrative department and registered with the administrative department for industry and commerce before it can start business. Article 7 The establishment of a book publishing house shall meet the following conditions:

(a) the organizers must be state organs and enterprises and institutions owned by the whole people, and have corresponding subordinate relations with their superiors;

(2) Having a clear purpose, publishing policy, professional division of labor and publishing scope;

(3) Having a president, a full-time editor-in-chief, a certain number of full-time editors and publishing managers;

(4) Having a fixed place, necessary material and technical conditions and funds. Article 8 It is forbidden to publish books with the following contents:

(a) in violation of the four cardinal principles;

(2) Advocating obscenity, pornography, murder and violence;

(three) involving state secrets;

(4) spreading feudal superstitions;

(5) distorting facts or slandering or framing others;

(6) Damaging national dignity and hurting national feelings;

(seven) other books prohibited by the state. Ninth book publishing units shall engage in publishing activities in accordance with the scope of publication and professional division of labor approved by the state publishing administrative department, and strictly implement the examination and approval system of topic selection plan and supplementary topic selection plan. Tenth book publishing units shall not publish publications with international standard book numbers. It is strictly forbidden for book publishing units to transfer, sell or sell ISBN in disguised form.

Non-book publishing units and individuals shall not engage in book publishing activities. Eleventh book publishing units shall abide by the relevant provisions of the state on collaborative publishing, printing publishing, self-funded publishing and book price management. Twelfth book publishing units should strictly abide by the provisions of the state on book quality management, and ensure the quality of book publishing.

The publishing administrative department shall strengthen the supervision and management of the quality of book publishing. Thirteenth publishing units must submit sample books to the provincial publishing administrative department and the national edition library within 30 days after the publication of books, and accept supervision and inspection. Article 14 A book publishing entity shall truthfully publish the registration number, title, author, editor in charge, address of publishing entity, printing unit, issuing unit, format, drawing sheet, number of words, edition, number of prints, standard book number, pricing and other contents on the book copyright record page in accordance with state regulations, and use bar codes in accordance with state regulations. Fifteenth official publications such as calendars, calendars, calendars, picture albums and desk calendars shall be published by relevant professional publishing units. Enterprises, institutions and other units need to print, must be approved by the provincial publishing administrative department in accordance with the relevant provisions, but not for sale. Sixteenth newspapers, radio, television and other media to publish, broadcast and publicize news and advertisements, must be officially published books and indicate the publishing unit. Seventeenth in violation of the provisions of the following acts, by the provincial publishing administrative department or the municipal (prefectural) publishing administrative department to give the following administrative penalties:

(a) the illegal establishment of a book publishing unit shall be banned according to law, the illegally published books and illegal income shall be confiscated, and a fine of more than 3 times the total price/kloc-0 times may be imposed.

(two) the publication of prohibited books, shall be confiscated and destroyed, confiscate the illegal income, and impose a fine of more than 0 times and less than 3 times the total price. If the circumstances are serious, it shall be ordered to suspend business for rectification or report to the state publishing administrative department for cancellation of publishing house registration.

(three) failing to report or conceal the topic selection plan in accordance with the provisions, and violating the provisions on the management of topic selection and the special examination and approval system, giving a warning or ordering to stop publishing; If the circumstances are serious, a fine of 5000 yuan shall be imposed.

(4) Whoever publishes books in the name of periodicals, buys and sells book numbers or buys and sells book numbers in disguised form, or publishes books without approval, shall have his illegal income confiscated and be fined 10000 yuan to 50000 yuan.

(five) beyond the scope of collaborative publishing, printing and publishing at their own expense, confiscate their illegal income, and may impose a fine of 50000 yuan to 65438 yuan according to the seriousness of the case.

(six) if the sample book is not submitted within the time limit, it shall be ordered to make up the report; If the circumstances are serious, a fine of 5000 yuan shall be imposed.

(seven) in the book copyright record page, if the relevant content is not truthfully published, it shall be ordered to replace the copyright page; If the circumstances are serious, a fine of less than 5,000 yuan shall be imposed.

(eight) unauthorized publication of calendars, calendars, calendars, paintings, desk calendars, shall be ordered to stop publishing, confiscate illegal publications and illegal income, and impose a fine of 30000 yuan to 50000 yuan on unauthorized publication of calendars; Unauthorized publication of calendars, calendar paintings, pictures and desk calendars may also be punishable by a fine of 10000 yuan to 30000 yuan.

If the parties have the above-mentioned illegal book publishing behavior, the publishing administrative department may, according to the seriousness of the case, punish them separately or jointly.

Confiscation income shall be implemented in accordance with the Regulations on the Enforcement of Confiscation of Property by Law Enforcement Organs in Henan Province.
