Measures for the implementation of preliminary design review of housing construction and municipal infrastructure construction projects in Sichuan Province

Article 1 In order to strengthen the preliminary design review of government-invested housing construction and municipal infrastructure construction projects with special provisions, standardize the scope and procedures of review, improve project quality, promote the conservation of resources and investment, and safeguard public interests and public safety, according to the Regulations of the State Council on Quality Management of Construction Projects and the Regulations on Survey and Design of Construction Projects. Regulations on Survey and Design of Construction Projects in Sichuan Province and the State Council's Decision on Investment System Reform (Guo Fa [2007])

Article 2 These Measures shall apply to the preliminary design review of housing construction and municipal infrastructure construction projects invested by the government within the administrative area of Sichuan Province (hereinafter referred to as the preliminary design review) and its supervision and management.

Article 3 The administrative departments of housing and urban and rural construction at or above the county level shall be responsible for the preliminary design review, supervision and management of housing construction and municipal infrastructure construction projects.

The administrative department of housing and urban construction shall, jointly with the development and reform, finance, projects and other departments at the same level, conduct a preliminary design review of government-funded housing construction and municipal infrastructure construction projects.

The preliminary design review of housing construction and municipal infrastructure construction projects with special provisions other than government investment shall be carried out in accordance with the relevant laws and regulations and the provisions of these Measures.

Article 4 The following housing construction and municipal infrastructure construction projects must be subject to preliminary design review according to law:

(1) Construction projects invested by the government;

(two) national and provincial key construction projects and other construction projects that should be subject to preliminary design review as stipulated by laws and regulations;

(three) large-scale housing construction and various municipal public facilities construction projects involving public interests and public safety.

(four) included in the national standard "classification standard for seismic fortification of building projects" (GB50223-2008) defined by the special fortification and key fortification construction projects.

Items (2), (3) and (4) belong to construction projects with special provisions, regardless of the source of investment and the nature of capital contribution.

In addition to the above provisions, small and medium-sized housing construction funded by private capital, foreign capital and non-governmental organizations does not belong to the scope of preliminary design review.

The term "housing construction and municipal infrastructure construction projects" as mentioned in these Measures refers to the large, medium and small construction industries (construction projects) and municipal construction projects stipulated in the design scale division table in the "Engineering Design Qualification Standard" (Jian Jian [2007] No.86) promulgated by the Ministry of Housing and Urban-Rural Development.

Article 5 After the preparation of preliminary design documents for the following large-scale housing construction and municipal infrastructure construction projects is completed, and before entering the preparation procedure of construction drawing design documents, the construction unit shall apply to the administrative department of housing and urban and rural construction of the province, city (state) respectively for preliminary design review in accordance with the scope of project supervision and the principle of grading review stipulated by laws, regulations and normative documents:

First, large-scale housing construction projects:

(a) a single building with a total area of more than 20 thousand square meters or a building height of more than 50 meters; Provincial small and medium-sized public buildings with complex technical requirements or economic, cultural and historical significance, as well as high-standard ancient buildings and protective buildings; Industrial workshops with complex technical requirements;

(2) Residential buildings with more than 20 floors;

(3) Planning and design of residential quarters and factory living quarters with a total construction area of over 300,000 square meters;

(4) Underground space utilization projects with a total construction area of 1 1,000 square meters or more and affiliated civil air defense projects with a protection level of four or more;

Second, large-scale municipal industry construction projects:

(1) water supply project: water purification plant with a capacity of 65438+ 10,000 m3/day and above, pumping station with a capacity of 200,000 m3/day and pipe network project with a diameter of 1.600 mm and above;

(2) Drainage works: sewage treatment plants with a capacity of 80,000 m3/day or more, pumping stations with a capacity of 654.38+10,000 m3/day, and pipelines with a diameter of 1.500mm or more;

(3) Gas project:1100,000 cubic meters/year and above urban gas transmission and distribution system (including all projects of gate stations, reserve stations, pressure regulating stations and pressure pipe network systems at all levels), artificial gas source plants with a capacity of 300,000 cubic meters/day and above, urban liquefied petroleum gas reserve stations with a capacity of 4,000 bottles/day and gas vehicle filling stations;

(4) Road engineering: independent interchange engineering and traffic facilities such as urban expressway, main road, overpass type, double horn type and hub type;

(5) Bridge works: bridges with a single span of 40 meters or more and a total length of 100 meters or more;

(six) urban tunnel engineering (regardless of scale);

(7) Public transport projects: Bus Rapid Transit System (BRT), electrical system, public transport lanes, bus stations and bus hubs with an area of over 6,000 square meters;

(eight) rail transit projects (regardless of scale);

(9) Environmental sanitation projects and solid waste treatment projects: domestic waste incineration projects, sanitary landfills with a daily treatment capacity of 500 tons or more, composting projects with a daily treatment capacity of 300 tons or more, transfer stations with a daily treatment capacity of 400 tons or more, hazardous waste treatment projects with a daily treatment capacity of 5 tons or more and medical waste treatment projects.

Three, according to the laws and regulations and the provisions of Article 4 of these measures, small and medium-sized public buildings, housing construction and municipal infrastructure construction projects that should be subject to preliminary design review shall implement the provisions of the design scale division table in the "Engineering Design Qualification Standard" promulgated by the Ministry of Housing and Urban-Rural Development, and apply to the municipal (state) and county (city, district) housing and urban-rural construction administrative departments for preliminary design review respectively.

Sixth is responsible for accepting and organizing the preliminary design review of the construction project category, scale and classification management responsibilities of the administrative department of housing and urban construction according to the following provisions:

(a) where included in the national and provincial people's government annual plan of key construction projects, by the provincial development and Reform Commission for examination and approval, approval or filing of housing construction and municipal infrastructure construction projects, submitted to the provincial housing and urban construction administrative departments to organize the review.

The State Council ministries approved, approved housing construction projects, by the provincial administrative department of housing and urban construction in conjunction with the project construction city (state) housing and urban construction departments to organize the review. Where laws, regulations and the state provide otherwise, such provisions shall prevail.

(II) The planning and design of large public buildings with a building height of more than 50 meters, residential buildings with a single building area of more than 50,000 square meters or a building height of 100 meters, residential quarters with a total building area of more than 300,000 square meters, out-of-code high-rise buildings and large-scale municipal infrastructure construction projects shall be submitted to the administrative department of housing and urban-rural construction of the province for organizing the preliminary design safety technical review.

The above-mentioned large-scale housing construction and municipal infrastructure construction projects under the jurisdiction of Chengdu shall be reviewed by the provincial administrative department of housing and urban and rural construction in conjunction with the Chengdu Urban and Rural Construction Committee. In addition to overrun high-rise buildings and some buildings with complex technology and huge single building volume, the provincial administrative department of housing and urban and rural construction may entrust Chengdu to organize the review.

(3) Construction projects approved, approved or put on record by the development and reform department of the city (state) and county (city, district) belong to other large-scale housing construction and medium-sized municipal infrastructure construction projects outside the circumstances specified in Item (1), and shall be organized and reviewed by the administrative department of housing and urban-rural construction of the city (state). Among them, the use of special funds from the Ministry of Finance and the Provincial Department of Finance for urban water supply projects, drainage projects, environmental sanitation and solid waste treatment projects shall be submitted to the provincial housing and urban construction administrative departments for review.

Complex technology or proprietary technology, architectural modeling has special requirements, the city (state) is not convenient to organize expert review, the city (state) housing and urban construction administrative departments can be submitted to the provincial housing and urban construction administrative departments to organize the review.

(4) Other small and medium-sized public buildings, housing construction and small municipal infrastructure construction projects funded by the government that should carry out preliminary design review according to law shall be reviewed by the administrative departments of housing and urban and rural construction at the same level as those examined and approved by the municipal and county (city, district) development and reform departments. Among them, small public buildings, houses and municipal infrastructure construction projects that belong to the category of Item (1) of Article 4 of these Measures, with single function and simple technical requirements, can no longer organize preliminary design review under the premise of not exceeding the budgetary estimate.

The construction scale and scope of special construction projects, such as the special review of seismic fortification of out-of-gauge high-rise buildings and the fire audit of large-scale crowded places, shall be implemented in accordance with the provisions of laws and regulations.

Article 7 The preliminary design review shall be organized by the administrative department of housing and urban-rural construction in conjunction with the relevant departments of construction projects, as well as relevant departments such as water supply, power supply and gas, and experts in related disciplines such as architecture, structure, water supply and drainage, heating and ventilation, electric power, roads, bridges, gardens, rock and soil, and cost.

Housing construction and municipal infrastructure construction projects invested by the government shall be reviewed by the administrative department of housing and urban and rural construction in conjunction with the competent departments and experts of development and reform, finance, urban and rural planning, etc.

Real estate development and large-scale housing construction projects belonging to private capital and foreign investment shall be reviewed by the administrative department of housing and urban-rural construction in conjunction with urban-rural planning, public security and fire protection, civil air defense and other departments and experts.

Municipal infrastructure construction projects with private capital and foreign investment shall be reviewed by the administrative department of housing and urban-rural construction in conjunction with the competent departments and experts of urban-rural planning, municipal roads, urban management, water supply and drainage, gas and so on according to the project category.

The departments and experts participating in the review shall be determined according to the relevant supervision and management departments and related majors involved in the construction project.

Article 8 When applying for preliminary design review, the construction unit shall submit the following materials:

(1) application form for preliminary design review of housing construction projects in Sichuan Province (see attached table 1 for details)

Application Form for Preliminary Design Review of Sichuan Municipal Infrastructure Construction Project (see Annex 2 for details).

(2) Providing relevant administrative approval documents according to law:

1. Documents (forms) for examination and approval, approval or filing of construction projects of development and reform departments (2 copies are required, of which 1 copy is provided by the review meeting and 1 copy is filed, the same below).

2, construction project site submissions (except for construction projects that have obtained the right to use construction land by way of transfer), construction land planning permit, planning and design conditions and materials, planning and building red line map, and review opinions of the planning and architectural design scheme of the administrative department of urban and rural planning;

3. Pre-examination opinions on land use for construction projects or approval documents for project construction land (transfer contract or certificate of state-owned construction land use right);

4. If the construction project involves the environmental impact assessment report, the approval or filing documents of administrative departments such as civil air defense, production safety, health and epidemic prevention, etc., which must be provided within the category, scale and scope stipulated by laws and regulations, and involves fire protection (as stipulated in Article 11 of the Fire Protection Law), water supply, air traffic control, subway, scenic spots and navigation, etc., it must provide the review or filing opinions of relevant competent departments.

Without the basis of laws and regulations or breaking through or expanding the categories, scale and scope stipulated by laws and regulations, the administrative department of housing and urban and rural construction shall not require the above-mentioned relevant approval or filing documents.

(three) to provide technical documents that meet the national mandatory standards for engineering construction. Mainly includes:

1, engineering geological investigation report of the proposed site (2 copies);

2, according to the law belongs to the special safety category (a) of major construction projects and construction projects that may cause serious secondary disasters, shall submit the seismic safety evaluation report (2 copies);

3, is a high-rise building project, need to be submitted to the provincial housing and urban construction department for examination and approval of the seismic fortification review opinions (2 copies);

4, should carry out special demonstration of municipal public facilities, need to submit special demonstration opinions (2 copies);

5, preliminary design documents (including design specifications, budget estimates, etc.). ). According to the scale and nature of the project, choose A3 or A2 drawings for binding. (More than 2 preliminary design documents, special projects will be decided separately)

Article 9 The content and depth of the preparation of preliminary design documents shall meet the needs of the preparation of construction drawing design documents, and meet the standards and requirements for the preparation of preliminary design documents for different professions and types of construction projects, among which the construction projects shall be implemented in accordance with the Provisions on the Preparation Depth of Design Documents for Construction Projects; Municipal infrastructure projects shall be implemented in accordance with the provisions on the depth of preparation of preliminary design documents for municipal public works.

Article 10 The administrative department of housing and urban and rural construction shall review the application materials submitted by the construction unit. If the application materials meet the statutory requirements, it shall, within 20 working days from the date of acceptance, hold a preliminary design review meeting in conjunction with the departments of development and reform, finance and projects, and organize experts to form written review opinions of the expert group signed by the experts. The administrative department of housing and urban and rural construction shall make a written reply within 10 working days after receiving the formal written examination opinions of relevant departments and expert groups.

Eleventh preliminary design review according to the following procedures:

(a) the construction unit shall submit a written application (application form), and the administrative department of housing and urban and rural construction shall determine the review department and experts according to the project category within the prescribed time limit, and determine the review date with the construction unit.

(two) the administrative department of housing and urban construction shall extract experts from the expert database of the provincial survey and design industry. Experts in the expert database can not meet the professional needs of preliminary design review, and with the consent of the provincial administrative department of housing and urban construction, other qualified experts can be invited.

The expert group is composed of experts from various disciplines, and the number of experts is determined according to the professional requirements involved in the preliminary design document review (7 or more large-scale construction projects). The expert group abides by the review avoidance system and gives consideration to the principle of proximity.

(three) 7 working days before the review meeting, send the notice of the meeting, the approval documents of the relevant departments and the preliminary design documents of the construction unit to the units and expert groups participating in the review meeting. The expert group shall, in accordance with the provisions of these measures, conduct an examination according to laws and standards, and put forward examination opinions. The review opinions shall specify the conclusions of the preliminary design review: review and approval, review and approval after modification, and re-compilation for submission.

(IV) The construction unit shall promptly submit the written review opinions of the participating units and expert groups to the administrative department of housing and urban-rural construction that organizes the review, as well as the preliminary design review files. Its contents mainly include:

1, a copy of the application form for preliminary design review of the construction unit and the approval of the relevant competent department (with the official seal of the construction unit affixed);

2. Technical documents in Item (3) of Article 9 of these Measures;

3, housing and urban construction administrative departments of the "meeting notice", "meeting sign-in form" original (signed by the relevant departments, experts and survey and design units to participate in the review);

4. Preliminary design review comments and summary comments (original):

(1) written review opinions of departments and units participating in the review;

(2) professional expert review opinions and expert group review opinions.

5. Other archival materials as prescribed by laws and regulations.

Twelfth preliminary design review should include the following main contents:

(a) the main indicators of the preliminary design are in line with the total construction area, the total investment budget, the urban and rural planning permission, and the land use specified in the decision on the transfer or allocation of the right to use state-owned construction land. Whether the preliminary design is implemented within the category, scale and scope stipulated by laws and regulations, and whether it meets the requirements in the approval or filing documents of the competent administrative department of fire protection and environmental protection.

(2) Construction projects funded by private capital, foreign capital and non-governmental organizations: whether the main indicators of the preliminary design meet the total construction area scale of the construction project approved, approved or filed, as well as the land use specified in the urban and rural planning permit, the contract for assigning the right to use state-owned construction land or the allocation decision. Whether the preliminary design is implemented within the category, scale and scope stipulated by laws and regulations, and whether it meets the requirements in the approval or filing documents of the competent administrative department of fire protection and environmental protection.

Private capital and foreign capital construction projects do not review the investment budget and investment construction standards, but mainly conduct safety technical review on whether the preliminary design implements the mandatory standards and norms of national engineering survey and design.

(three) whether the design unit strictly implements the specific requirements of the relevant administrative departments according to law.

(four) focus on the review of the preliminary design of seismic fortification classification standards, structural safety, building energy efficiency, barrier-free construction standards, as well as the implementation of renewable energy building application (demonstration); The implementation of relevant professional engineering technical specifications and standards, focusing on the implementation of mandatory standards for engineering construction; Implementation of relevant laws, regulations and standards of various disciplines in the construction field.

School buildings, medical buildings, stadiums, museums, cultural centers, libraries, theaters, shopping malls, hotels, transportation hubs and other crowded public buildings, as well as special fortified buildings such as scientific experimental buildings prone to serious secondary disasters after the earthquake, should focus on reviewing whether the seismic fortification intensity standards specified in the preliminary design documents strictly implement the mandatory provisions of the Classification Standard for Seismic Fortification of Building Projects that have strengthened their seismic measures.

(five) whether it meets the design depth requirements of the preliminary design stage stipulated by the state and whether it meets the needs of compiling construction drawing design documents.

(six) whether the new technologies, new processes and new materials to be adopted in the design are within the scope of encouragement, support and promotion by the state, and whether there are application examples of the project category and scale; According to the industry characteristics of the project, review the rationality and advancement of process and equipment selection in the preliminary design.

(seven) whether the technical and economic analysis and comparative analysis are carried out on the main technical schemes of related majors, and whether they are safe and reliable.

(eight) whether the project budget is prepared in accordance with the relevant provisions of the state and the current project cost in Sichuan Province, and whether the depth meets the requirements.

Thirteenth design units shall, according to the review opinions, revise and improve the administrative departments of housing and urban and rural construction and the competent departments of projects that organize the preliminary design review in writing. If the review opinions do not conform to the mandatory national engineering construction standards, design specifications and relevant technical standards, and there are unreasonable review opinions, the design unit shall put forward the relevant technical standards, normative basis and reasons for not adopting the opinions in writing.

The construction drawing review institution shall, according to the preliminary design review reply of the administrative department of housing and urban and rural construction, review whether the construction drawing implements the preliminary design review reply.

Fourteenth province, city (state), county (city, district) housing and urban construction administrative departments of the preliminary design review application materials submitted by the construction unit in any of the following circumstances, it shall require rectification:

(a) the design basis is obviously wrong and the standard specification of the design basis is invalid, incorrect or insufficient;

(two) does not meet the requirements of the current national construction engineering design document preparation depth, there are important omissions, missing items;

(three) does not meet the current national mandatory standards for engineering construction, and the use of backward and obsolete technologies, equipment or materials does not meet the current technical industry policies and management regulations;

(four) the preliminary design of government-funded construction projects has serious unreasonable problems such as exceeding the estimated budget and exceeding the budget;

(five) in violation of the statutory basic construction procedures.

Article 15 Once the preliminary design documents are approved, no unit or individual may modify them without authorization. In accordance with the laws and standards, it should be revised by the original design unit, or with the consent of the original design unit, it should be revised by a design unit with corresponding qualifications. The construction unit will report the revised preliminary design documents to the administrative department of housing and urban and rural construction for re-examination. Among them, the modification of the main contents of the project feasibility study report, investment scale, investment source composition, construction scale, urban and rural planning permission, etc. shall be approved by the competent departments of development and reform, finance and urban and rural planning respectively, and then re-apply for preliminary design review.

Article 16 The construction unit shall be responsible for the legality, authenticity, accuracy and timeliness of the application materials.

Seventeenth construction units shall be submitted to the administrative departments of housing and urban and rural construction at all levels for preliminary design review, but the construction projects that have not been submitted for review shall not be entrusted to enter the construction drawing review procedure. Housing and urban and rural construction administrative departments shall, when issuing construction permits, review the preliminary design approval documents in accordance with the categories, scale and scope of housing construction and municipal infrastructure construction projects as stipulated by laws and regulations and in accordance with the provisions of laws and regulations and this circular. If the administrative department of housing and urban-rural construction fails to organize the preliminary design review, it shall suspend the application for construction permit, request rectification and inform.

According to the provisions of relevant laws and regulations and these Measures, if a construction project that should be subject to preliminary design review according to law fails to declare or pass the review, when the construction unit entrusts the construction drawing design document review, the construction drawing review institution shall request and inform the construction unit to conduct preliminary design review according to law. If the construction drawing review institution accepts the entrustment in violation of the regulations, it shall be recorded in the bad credit record according to law. If losses are caused, it shall bear the corresponding liability for compensation according to law.

Eighteenth after the completion of the preliminary design review, the administrative department of housing and urban construction shall require the construction unit to file the following documents according to law, and incorporate them into the project completion acceptance files:

(a) the preliminary design review and approval documents;

(two) the filing materials stipulated in item (four) of article eleventh of these measures.

Nineteenth provincial housing and urban construction administrative departments should implement unified management of the province's housing construction and municipal basic engineering preliminary design review expert database, and establish a unified database platform. The preliminary design review experts shall be selected from experts who have been engaged in survey, design, scientific research, teaching and management for a long time, and shall bear the corresponding review responsibility for the preliminary design review opinions.

The provincial administrative department of housing and urban and rural construction shall implement dynamic management of the expert database, and timely supplement or adjust the warehousing experts according to the needs of the evaluation work.

Twentieth departments, experts and staff who organize and participate in the preliminary design of classified projects shall strictly abide by the provisions of the secrecy law. All relevant documents and materials involved in the design review shall be recovered and kept according to law.

Article 21 Units and individuals who violate laws and regulations in the preliminary design review of construction projects and related activities shall be punished in accordance with the Construction Law of People's Republic of China (PRC), Regulations on Quality Management of Construction Projects, Regulations on Survey and Design of Construction Projects, Regulations on Survey and Design of Sichuan Construction Projects and other laws and regulations.

Article 22 These Measures shall be implemented as of 2011121.
