Interim Measures for Planning, Construction and Management

Chapter I General Provisions

Article 1 In order to strengthen the planning, construction and management of urban parking facilities in the whole province, according to the Urban and Rural Planning Law of People's Republic of China (PRC), the Road Traffic Safety Law of the People's Republic of China, the Regulations on Road Traffic Safety in Gansu Province, the Guiding Opinions of the Ministry of Housing and Urban-Rural Development, the Ministry of Public Security and the National Development and Reform Commission on Planning, the Construction and Management of Urban Parking Facilities, the Specification for Setting Parking Spaces on Urban Roads and the Regulations on Urban Parking Spaces in Gansu Province.

Article 2 The term "parking lot" as mentioned in these Measures refers to outdoor or indoor (including above-ground and underground) places built (set up) in urban built-up areas for parking motor vehicles, including public parking lots, special parking lots, temporary parking lots and on-street parking spaces. Public parking lot refers to the place mainly for social vehicles to park; The special parking lot refers to the place mainly for the personnel of the unit, the owners of residential areas or other specific groups to park special vehicles such as motor vehicles and dangerous chemicals transportation; Temporary parking lot refers to the temporary parking lot where large-scale mass activities are held; On-street parking refers to the temporary occupation of roads to park motor vehicles without affecting the passage of other vehicles and pedestrians.

Article 3 These Measures shall apply to the planning, construction and management of parking lots within the administrative area of this province.

Article 4 Cities should follow the requirements of government-led, local conditions, overall planning and coordinated development, so as to ensure smooth and orderly traffic, optimize the allocation of resources, and facilitate the people to set their behavior goals, and adhere to the principles of unified planning, rational layout, management according to law, resource conservation, differential supply and regulation and management of parking demand. City parking fees and standards according to the provisions of the provincial development and reform department (price department).

Chapter II Planning and Construction

Article 5 Each city shall, according to the urban traffic development strategy and objectives determined by the overall urban planning and urban comprehensive transportation system planning, prepare a special plan for urban parking facilities, which shall be implemented after being organized by the provincial construction administrative department for technical review and reported to the people's government at the same level for approval.

Article 6 A city shall establish and improve a scientific parking demand management system, strictly control the number of occupied parking spaces, and gradually form an urban parking pattern that focuses on construction parking, supplemented by off-street parking and occupied parking.

Seventh cities should strengthen the traffic impact assessment of new large-scale construction projects to prevent the emergence of new traffic congestion nodes. It is necessary to do a good job in the allocation and construction of parking lots in densely populated areas such as large public buildings, residential quarters, bustling commercial blocks and schools, rationally regulate parking demand, and improve urban static traffic order. The construction of parking lots must meet the requirements of urban planning and ensuring safe and smooth road traffic.

Encourage construction projects to use underground space to build parking facilities, and the underground parking area built according to construction standards is not included in the volume ratio calculation.

Article 8 All relevant departments shall strengthen the supervision and inspection of the construction and use of parking facilities in construction projects, and prohibit the use of parking facilities for other purposes.

Ninth new construction, renovation and expansion of the following buildings, blocks and places, should be in accordance with the urban comprehensive transportation system planning and urban regulatory detailed planning with the construction, increase (expand) the construction of parking lots:

(1) Railway stations, ports, airports and highway passenger and freight hubs;

(2) Offices, schools, kindergartens, gymnasiums, theaters, libraries, hospitals and exhibition places of administrative institutions;

(3) Scenic spots and other tourist attractions;

(four) large (medium) shopping malls, bazaars, hotels, restaurants and business premises;

(five) other large public buildings.

Tenth city parking facilities construction should strengthen the coordination with landscaping, urban landscape and other human settlements, and shall not occupy urban green space.

The design scheme of public parking lot construction project shall meet the requirements of relevant national and provincial standards and design specifications, and set up special parking spaces for the disabled according to the parking needs of the disabled.

Eleventh public parking lot construction projects should be carried out in accordance with the approved design scheme. The main project of a construction project and the parking lot shall be designed, constructed and delivered at the same time.

Twelfth in the planning and construction of parking facilities, we should fully consider the needs of the popularization of new energy vehicles such as electric vehicles, and build, transform or reserve related supporting facilities such as charging to meet the development requirements of new energy vehicles.

Thirteenth city parking lot construction projects and ancillary facilities project completion and acceptance, it shall notify the public security traffic management department to participate. Without acceptance or unqualified acceptance, it shall not be put into use.

Chapter III Use and Management

Article 14 The setting of temporary parking lots shall meet the requirements of safe and smooth road traffic and the corresponding technical specifications.

In case of emergency or when holding large-scale mass activities, the public security traffic management department may determine temporary parking areas or suspend the use of road parking spaces within the road.

Fifteenth city blocks of motor vehicle parking spaces, public security traffic management departments can be based on traffic conditions, in the road within the scope of temporary parking spaces, and the use of parking spaces and set up warning signs. No other unit or individual may set up or dismantle road parking spaces or set up parking obstacles.

Without affecting the passage of pedestrians and vehicles, the public security traffic management department may, jointly with the urban construction administrative department, transportation and other relevant departments, set up temporary parking spaces for taxis on the main roads of the city for passengers to ride in time.

Article 16 When setting up on-street parking spaces, the public security traffic management department shall delimit parking spaces and set up parking signs in accordance with the relevant national standards such as "Specification for Setting on-street Parking Spaces on Urban Roads". The parking sign shall clearly indicate the parking type, the number of berths and the use time of berths.

The public security traffic management department shall, jointly with the planning, urban construction and other departments, solicit public opinions when planning new on-street parking spaces.

On-street parking fees need to be approved by the development and reform department (price department), and the fees will be turned over to the local finance for the construction of public parking facilities.

Seventeenth public parking lot managers should report to the local county (city, district) public security traffic management department for approval and issue parking permits after the completion and acceptance of the parking lot construction.

Eighteenth public security traffic management departments should regularly announce the specific location of local parking lots, the number of berths and the charging standards approved by the development and reform department (price department).

Nineteenth to encourage state organs, social organizations and other public services, public welfare institutions and parking spaces in urban central parking lots (garages) to open to the public.

Article 20 The supervision and inspection of road parking spaces and occupied roads shall be strengthened according to law, and strict management shall be conducted by legal, administrative and economic means, so as to give full play to the functions of existing road facilities, improve road service level and ensure safe and smooth roads.

Twenty-first public parking lots shall not be used for other purposes, and parking lots put into use shall not be parked without authorization. The original planning for the parking lot (garage), but in the process of using the change of use, the local people's government should be forced to restore its parking function.

Twenty-second public parking lot managers shall abide by the following provisions:

(a) in the parking lot in accordance with the provisions, set up obvious entrance signs, driving guide signs, public signs, pass (slope) anti-slip lines and corner safety goggles, delimit parking spaces, open management systems and charging standards, and allocate necessary facilities and equipment such as ventilation, lighting, drainage, communication and monitoring according to needs, and ensure normal use;

(two) shall not engage in other business activities that affect the driving and parking of vehicles in the parking lot;

(three) to do a good job in fire prevention, theft prevention and other security work in the parking lot, in case of fire, traffic accidents, public security and criminal cases, immediately take corresponding measures and call the police.

Twenty-third special parking lots are managed by their owners or land use rights holders.

The provisions of Item (2) of Article 22 of these Measures shall apply to providing non-operating parking services for the personnel of this unit, the owners of this residential area or other specific groups; The provisions of Article 25 of these Measures shall apply to the special parking lot that provides business parking services to the society.

Twenty-fourth in accordance with the urban comprehensive transportation system planning and construction of the parking lot, the owner or land use right holder can use it as a special parking lot or public parking lot to provide parking services to the public. No other unit or individual may occupy or set up parking obstacles.

Article 25 The management of temporary motor vehicle parking lots and on-street parking spaces shall comply with the following provisions:

Set up eye-catching parking lot signs in a prominent position at the entrance and exit of the parking lot; According to the need to configure the necessary lighting, monitoring and other facilities and equipment, and ensure the normal use; When the relevant departments of the local people's government make a decision to cancel the parking lot or increase or decrease the parking space according to law, they shall do a good job in accordance with the provisions of Article 22 of these Measures.

Article 26 All localities should, in accordance with the overall requirements of scientific allocation of resources, reasonable adjustment of demand and adjustment of management income, improve the price formation mechanism of public parking lots on the basis of comprehensive consideration of factors such as resource occupation cost, traffic structure adjustment cost, facility construction cost and operation and management cost, formulate parking fee pricing and adjustment methods, and strictly regulate parking fee management.

Twenty-seventh adopt differential rates to adjust parking demand and parking resources, implement differential parking prices from high to low from the central area of the city to the periphery of the city, strengthen the regulation and management of parking demand, establish income adjustment mechanisms for different types of parking lots, and guide the rational use of parking resources; According to the different parking resources, the parking rates of different models and different parking times are reasonably determined.

Twenty-eighth operators and managers of operating parking lots shall handle tax registration according to law, and the local tax authorities shall handle tax registration and issue tax invoices with the license issued by the public security traffic management department. Operators and managers of parking lots shall operate and pay taxes according to law.

Twenty-ninth guide the establishment of industry service evaluation system, strengthen industry self-discipline, and take various ways to increase the supervision of parking service business units. Take preferential policies to promote the development of parking industrialization.

Thirtieth city parking service business units shall strictly abide by the relevant laws, regulations and rules, establish and improve the internal management system, charging system and service standards. It is necessary to strengthen the professional ethics education and service skill training of parking service personnel and continuously improve the parking service level. The operating parking lot shall have perfect parking facilities, complete safety monitoring facilities and signs and markings in line with relevant national standards and norms.

Article 31 If the staff of operating parking lots do not wear uniform service marks, fail to issue parking vouchers and invoices supervised by local tax authorities according to regulations, or collect parking fees beyond the standards approved by the price department, the drivers of motor vehicles have the right to refuse to pay the parking fees.

Thirty-second motor vehicle drivers should abide by the following provisions when parking their vehicles in the parking lot:

Abide by the parking lot management system, obey the command of the parking lot staff, and drive and park vehicles according to the instructions of traffic signs and markings; Maintain the environmental sanitation of the parking lot, do not throw away garbage or other wastes at will in the parking lot, and do not damage the parking facilities and equipment; Abide by the relevant provisions on fire safety; Pay parking fees according to the standards approved by the development and reform department (price department).

Thirty-third motor vehicle parking lots and road parking spaces put into use shall meet the national standards such as road traffic signs and markings, parking garage (field) safety management system technical requirements.

Conditional public parking lots shall be equipped with special parking spaces for the disabled in accordance with the Code for Barrier-free Design of Urban Roads and Buildings.

Chapter IV Supervision and Inspection

Article 34 If the traffic administrative department of the public security finds that the parking lot that has been put into use has traffic safety hazards or affects the smooth road traffic, it shall promptly report to the local people's government and put forward suggestions on preventing traffic accidents, eliminating hidden dangers, stopping construction or rebuilding the parking lot.

Thirty-fifth public security traffic management department and its traffic police have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) illegal administrative license;

(two) other dereliction of duty, abuse of power, corruption.

Thirty-sixth public security traffic management departments shall guide, supervise and inspect the use and management of parking lots according to law. Development and reform departments at all levels (price departments) shall supervise and inspect parking fees according to law. The illegal acts and traffic safety hazards found shall be dealt with in a timely manner according to law or handed over to relevant departments for handling.

Thirty-seventh motor vehicle parking lot, road parking management personnel dereliction of duty, abuse of power, corruption, bribery, punished by the competent authorities; If the case constitutes a crime, criminal responsibility shall be investigated according to law; If losses are caused to the parties concerned, compensation shall be made according to law.

Chapter V Supplementary Provisions

Thirty-eighth municipalities, state construction, public security, development and reform departments can formulate detailed rules for implementation according to these measures.

Article 39 These Measures shall come into force as of the date of promulgation.
