The term "demolished person" as mentioned in these Regulations refers to the owner of the demolished house. Article 5 The municipal housing demolition management department shall supervise and manage the housing demolition work in this Municipality, and may entrust the municipal urban construction demolition resettlement office to exercise the supervision and management duties of the housing demolition work in Kundulun District, Qingshan District, Donghe District and Jiuyuan District.
Planning, construction, environmental protection, public security, culture and other departments shall cooperate with each other in accordance with the provisions of these regulations to ensure the smooth progress of house demolition.
The land administrative departments of the people's governments at or above the county level shall be responsible for the land management related to urban housing demolition in accordance with the provisions of relevant laws and regulations.
The People's Government of Baiyunebo Mining Area and the People's Government of Shiguai District are responsible for the management of house demolition work, and exercise the management responsibilities of house demolition work within their respective jurisdictions in accordance with these regulations. Chapter II Demolition Management Article 6 A house demolition unit may only carry out demolition after obtaining a house demolition permit. Article 7 To apply for a house demolition permit, the following materials shall be submitted to the house demolition management department:
(1) A written application;
(two) the approval documents of the construction project;
(3) Construction land planning permit;
(four) the approval document of the right to use state-owned land;
(five) housing demolition plan and compensation and resettlement plan;
(6) A certificate of compensation and resettlement funds issued by a financial institution handling deposit business. The deposit amount of relocation compensation and resettlement funds shall not be less than 60% of the required relocation compensation and resettlement funds. Eighth housing demolition management department shall complete the audit within 7 working days from the date of receiving the above information. In accordance with the provisions of the provisions of article seventh, shall be issued a "house demolition permit"; If not, it shall notify the applicant in writing. After the demolition has obtained the permit for house demolition, it shall issue a notice of house demolition to the demolition within 3 days, and announce the compensation and resettlement plan for the demolition.
Housing demolition management departments and residents should do a good job in publicity and explanation to residents. Tenth people should be taken in the "Housing Demolition Permit" to determine the scope and duration of the demolition, the implementation of housing demolition in accordance with the law.
Need to extend the demolition period, the demolition should be before the expiration of the demolition period, apply to the housing demolition management department for an extension of the demolition; The house demolition management department shall give a written reply within 10 days from the date of receiving the application for extension of demolition. Eleventh people can take their own demolition, can also entrust a qualified unit to carry out the demolition.
If the demolisher entrusts the demolition, he shall issue a power of attorney to the entrusted demolition unit and conclude a demolition entrustment contract. Demolition should be reported to the house demolition management department for the record within 05 days from the date of the conclusion of the house demolition entrustment contract.
The entrusted house demolition unit shall not transfer the demolition business. Twelfth housing demolition management department shall not be taken as a demolition, nor shall it accept the demolition commission.
The land purchase reserve determined by the Municipal People's Government may be handled by the land purchase reserve institutions within the scope of land use planning and zoning approved by the municipal land and resources management department, and the demolition procedures shall be handled by the municipal housing demolition management department. Thirteenth in the scope of housing demolition permit shall not carry out the following activities:
(1) Building, expanding and rebuilding houses;
(two) the change of housing or land use;
(3) Lease, mortgage and transaction of houses.
Where the provisions of the preceding paragraph are implemented, the house demolition management department shall notify the relevant departments in writing to stop handling relevant procedures and publicize them within the scope of demolition. Fourteenth residents and relevant units in the announcement of the relocation period, not to be taken or housing users have not moved out of the house to stop water supply and power supply. Heating, gas supply and damage to the building structure affect the safety of production, life and residence. Fifteenth demolition and demolition should be based on this Ordinance on the way and amount of compensation, resettlement housing area and resettlement location, relocation period, relocation transition mode and transition period, liability for breach of contract and other matters to conclude a compensation and resettlement agreement.
Demolition of rental housing, the demolition should be taken and the lessee signed a demolition compensation and resettlement agreement.
If the houses managed by the house demolition management department need to be demolished, the demolition compensation and resettlement agreement shall be notarized by a notary office, and the evidence shall be preserved.
