Article 1 In order to improve the level of reduction, recycling and harmlessness of domestic garbage, promote the construction of ecological civilization and realize the sustainable development of the city, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality.
Article 2 These Measures shall apply to the classification, reduction and related management activities of domestic garbage within the administrative area of this Municipality.
Article 3 The term "domestic waste" as mentioned in these Measures refers to the solid waste generated by units and individuals in their daily life or activities providing services for daily life, including kitchen waste, construction waste, recyclable materials, hazardous waste and other wastes. If there are other provisions on kitchen waste and construction waste, those provisions shall prevail.
Article 4 The classification and reduction management of domestic waste shall follow the principles of government leading, territorial management, public participation, market operation and social supervision. Domestic waste should be classified, put in, collected, transported and treated.
Article 5 This Municipality shall establish a joint meeting system to promote the classification and reduction of domestic waste, and coordinate and solve major problems in the classification and reduction of domestic waste.
The District People's Government (including the Administrative Committee of the New District, the same below) is responsible for organizing the implementation of the classification and reduction of domestic waste within its jurisdiction, and establishing a capital investment and guarantee mechanism. Sub-district offices are responsible for the specific implementation of domestic waste classification and reduction within their respective jurisdictions.
Article 6 The municipal administrative department in charge of urban management (hereinafter referred to as the municipal competent department) is the competent department in charge of domestic waste classification and reduction in the whole city, organizing the formulation of management targets for domestic waste classification and reduction, and being responsible for the organization, promotion, inspection, guidance, supervision and assessment of domestic waste classification and reduction.
The district urban management administrative department (hereinafter referred to as the district competent department) is responsible for the guidance, supervision and management of the classification and reduction of domestic waste within its jurisdiction.
Seventh economic and trade information department is responsible for the supervision and management of the comprehensive utilization of renewable resources. The environmental protection department is responsible for the supervision and management of hazardous waste treatment. The housing and construction department is responsible for urging property service enterprises to fulfill their obligations of classifying and reducing domestic waste.
Other administrative departments shall, in accordance with their respective responsibilities and the provisions of these measures, do a good job in the classification and reduction of domestic waste.
Article 8 All units and individuals shall fulfill their obligations of classifying and reducing domestic garbage and maintain a good urban environment.
Article 9 The municipal competent department shall announce to the public the ways, procedures and time limits for reporting and complaining about the illegal activities of domestic waste classification and reduction, handle the reports and complaints according to law, and feed back the results. Chapter II Classification Standards and Classification Delivery Article 10 Domestic garbage in this Municipality is divided into three categories according to the following standards:
(1) recyclables refer to waste paper, waste plastics, waste glass, waste metal, waste fabrics, waste electronic products, etc. Can be recycled;
(2) Hazardous waste refers to waste batteries, waste lamps, waste medicines, waste pesticides, waste paints, waste daily chemicals, waste silver products, etc. Causing direct or potential harm to human health or the natural environment and requiring special treatment;
(3) Other garbage refers to other wastes except recyclable and hazardous wastes.
Encourage residential areas and other places with treatment conditions to divide domestic garbage into recyclables, harmful waste, kitchen garbage and other garbage. Food waste can be included in the food waste collection and transportation system for collection and transportation.
The municipal competent department may, according to the actual situation of domestic waste management, put forward an adjustment plan for the classification standard of domestic waste on the basis of full consultation and scientific demonstration, which shall be implemented after being approved by the Municipal People's Government and announced to the public.
The municipal competent department shall, jointly with the economic and trade information, environmental protection and other departments, formulate a specific catalogue of domestic waste classification and announce it to the public.
Article 11 This Municipality implements the management system for the person responsible for the classified delivery of domestic garbage.
According to the following provisions, determine the person responsible for the management of domestic waste classification:
(a) the party and government organs, units stationed in Shenzhen, enterprises and institutions, social organizations and other organizations of the office and production sites, by the unit responsible for. The implementation of property management, property services companies as the responsible person; If the unit is in charge, the unit is the responsible person;
(two) residential areas, by all the owners. The implementation of property management, property services companies as the responsible person; If the owner manages the property by himself, the owner shall be the responsible person; If the property management is not implemented, the responsible person shall be determined by the local street office;
(three) roads, squares, parks, public green spaces and other public places, the management unit or its entrusted unit is the responsible person;
(four) airports, passenger stations, rail transit, tourism, culture, sports, entertainment, business and other public places, by the management unit. In accordance with the provisions of the second paragraph of this article, if the person in charge of management cannot be determined, the person in charge of management shall be determined by the local street office. Article 12 The person in charge of the management of classified delivery of domestic garbage shall perform the following obligations:
(a) in accordance with the provisions of the domestic garbage collection container, and keep the container intact and clean;
(2) Publicizing the time and place of classified delivery of domestic garbage;
(three) to guide the classified delivery work, and to persuade and stop the behavior that does not meet the requirements of classified delivery;
(4) Establish a ledger for the classified collection and management of domestic garbage, record the types, quantities, transporters and destinations of domestic garbage generated within the scope of responsibility, and regularly submit data to the sub-district offices under their jurisdiction;
(5) Classified domestic garbage shall be collected and transported by qualified units. Management units of gymnasiums, parks, cinemas, concert halls, libraries, airports, passenger stations, subways, railway stations and other public places, and management units of municipal street lighting facilities, schools and hospitals. , recycling waste lamps and handing them over to qualified units for treatment.
Legal basis:
Article 1 of the Regulations of Shenzhen Municipality on the Classified Management of Domestic Waste stipulates the classified delivery, classified collection, classified transportation, classified treatment, source reduction and related management of domestic waste. This means that Shenzhen garbage classification has entered the era of "compulsory classification" from "active classification".
