According to the provisions of the Interpretation of the Supreme People's Court on Several Issues Concerning the Specific Application of Law in the Trial of Criminal Cases of Illegal Publications, Article 218 of the Criminal Law "huge amount of illegal income" means that the amount of illegal income of individuals is more than 100,000 yuan and that of units is more than 500,000 yuan.

According to Article 217 of China's Criminal Law: "Whoever commits one of the following acts of copyright infringement for the purpose of making profits, and the amount of illegal income is relatively large or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also or only be fined; If the amount of illegal income is huge or there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and fined. " If the unit sales exceeds 2 million yuan, the circumstances are serious. If there are no other statutory lighter or mitigated circumstances, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also, or shall only, be fined.

At the same time, if the public interest is harmed, the copyright administrative department may order it to stop the infringement, confiscate the illegal income, confiscate and destroy the infringing copy, and may also impose a fine;

If the circumstances are serious, the copyright administrative department may also confiscate the materials, tools and equipment mainly used for making infringing copies; (1) Reproduction, distribution, performance, projection, broadcasting, compilation and dissemination to the public through information networks without the permission of the copyright owner, except as otherwise provided by this Law;

If the listed infringement acts harm the interests of the public at the same time, and the illegal business amount is more than 50 thousand yuan, the copyright administrative department may impose a fine of more than 1 times and less than 5 times of the illegal business amount;

If there is no illegal business amount or the illegal business amount is less than 50 thousand yuan, the copyright administrative department may impose a fine of less than 250 thousand yuan according to the seriousness of the case.
