Catalogue of Classified Management of Environmental Impact Assessment of Construction Projects (20 17)
Article 1 This Catalogue is formulated in accordance with Article 16 of the Environmental Impact Assessment Law of the People's Republic of China for the purpose of classified management of environmental impact assessment of construction projects. Article 2 According to the characteristics of construction projects and the environmental sensitivity of the region where they are located, the environmental impact assessment of construction projects shall be managed in a classified manner by comprehensively considering the possible environmental impact of construction projects.

The construction unit shall, in accordance with the provisions of this catalogue, organize the preparation of the environmental impact report, environmental impact report form or fill in the environmental impact registration form of the construction project. Article 3 The environmentally sensitive areas mentioned in this catalogue refer to all kinds of protected areas established according to law and areas that are particularly sensitive to the environmental impact of construction projects, mainly including the following areas within or outside the red line of ecological protection:

(1) Nature reserves, scenic spots, world cultural and natural heritage sites, special marine reserves and drinking water source protection areas;

(2) Basic farmland protection areas, basic grasslands, forest parks, geological parks, important wetlands, natural forests, important wildlife habitats, key protected wild plants growth and breeding sites, natural spawning grounds for important aquatic organisms, feeding grounds, wintering grounds and migration routes, natural fishing grounds, key areas for soil erosion prevention and control, protected areas with closed sandy land, and sea areas with closed fishing seasons and semi-closed fishing seasons;

(3) Areas with residence, medical and health care, culture and education, scientific research and administrative office as their main functions, and cultural relics protection units. Article 4 The construction unit shall determine the environmental impact assessment categories of construction projects in strict accordance with this Catalogue, and shall not change the environmental impact assessment categories without authorization.

Environmental impact assessment documents should focus on the impact of construction projects on environmentally sensitive areas. Article 5 The categories of environmental impact assessment of cross-industry and compound construction projects shall be determined according to the highest level of individual projects. Article 6 The categories of environmental impact assessment for construction projects not specified in this Catalogue shall be proposed by the provincial competent department of environmental protection according to the characteristics of pollution factors and ecological impact factors of construction projects and the sensitive nature and degree of their environment, and reported to the Ministry of Environmental Protection for confirmation. Article 7 The Ministry of Environmental Protection shall be responsible for the interpretation, timely revision and publication of this catalogue. Article 8 This Catalogue shall come into force on September 20 17 1 day. The original Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects (Order No.33 of the Ministry of Environmental Protection) issued on April 9, 20 15 shall be abolished at the same time.
